This agreement is made between Melinda Ozel and the individual participant (“Participant”). By purchasing access to the FACS Cram Session, the Participant agrees to the following terms and conditions:
1. Copyright and Intellectual Property
1.1. All materials (unless otherwise stated) provided in the FACS Cram Session, including but not limited to slides, videos, GIFs, diagrams, and PDFs, are the exclusive intellectual property of the Host.
1.2. Participants are granted a non-exclusive, non-transferable license to access and view these materials for personal and educational purposes only.
1.3. Redistribution, reproduction, or uploading of any materials to any website, platform, or shared resource is strictly prohibited. This includes, but is not limited to, studio or company websites, online platforms, or personal/shared drives.
1.4. Participants may not share or distribute the session video, recording, or PDF with any third party, whether for free or for a fee.
2. Recording and Video Access
2.1. This is a pre-recorded, and all paying participants will receive access to the recording and the accompanying PDF.
2.2. The video will be hosted on a secure platform and will not be downloadable. Access will be granted exclusively to the Participant for a two-year period.
3. Refunds
3.1. All sales are final. Refunds will not be provided under any circumstances..
4. Access and Availability
4.1. Access to the video will be provided for a two-year period, and access to the PDF will be downloadable. After the two-year period, video access may be revoked unless otherwise agreed upon.
4.2. Participants agree not to download or otherwise retain copies of the video without explicit written permission from the Host.
5. Indemnification and Enforcement
5.1. The Host reserves the right to pursue legal action as well as reimbursement of costs of legal expenses and court fees, or other remedies in the event of unauthorized use or distribution of the training materials.
6. Governing Law and Dispute Resolution
6.1. This agreement is governed by the laws of Texas.
6.2. Any disputes arising from this agreement shall be resolved through arbitration or mediation before pursuing litigation, using a licensed arbitrator from the state of Texas, paid equally by the parties, with the arbitrator having the ability to reallocate fees if deemed appropriate by the arbitrator.
7. Agreement to Terms
By purchasing access to the FACS Cram Session, the Participant acknowledges that they have read, understood, and agreed to the terms and conditions outlined in this agreement.
